Responding to a frequent complaint, on December 2, the Federal Motor Carrier Safety Administration initiated a rule-making proposing to include “adjudication information” relevant to a commercial driver’s record in his or her Compliance – Safety – Accountability (CSA) roadside inspection record. That would mean that if a driver’s roadside citation is dismissed in court, or downgraded, the updated finding would be recorded in the driver’s CSA BASIC record, where insurers, employers, or shippers could draw conclusions from it. Notably, the proposal is not simply to eliminate the record of a dismissed citation from the BASIC. The public comment docket for this proposed regulation is open until January 2.
